Summary of Facts:
Eleni Voulgaris, an adult female entering a building owned and maintained by defendants Schlitz Rivercenter, LLC and The Brewery Works, Inc. d/b/a Schlitz Park, reportedly suffered an isolated right tibia fibular fracture, requiring surgery, as a result of slipping on ice as she was entering the building. The plaintiff alleged the defendants failed to enact policies and procedures to discover and remedy unsafe conditions, failed to diligently inspect and maintain the premises in a safe manner, and failed to provide adequate notice and warning of the condition of the property. The defendants filed a third-party complaint against David J. Frank Landscape Contracting, Inc., and its insurer, Integrity Mutual Insurance Company, seeking contribution since David J. Frank Landscape Contracting, Inc. was responsible for snow and ice removal at the front of the building. The plaintiff reached a settlement with the defendants and third-parties defendants in the amount of $90,000.
